We've pasted below the email we received from the Head of Planning earlier today.
In essence, the airport want to avoid a proper and public planning process where all can get involved. They've tried it before and failed. But we have to go through the process. We're pleased that the council is making the decision to do a full call for evidence; we've called for this ourselves and it gives local groups like GALBA the opportunity to use the evidence they've collected.
We do have a question about how this works that GALBA have raised with us, so we’ll share more on this next week. For now we’re just outlining what’s happening.
Thanks also to the residents who came along to our 'community committee' meeting on Monday to discuss this!
"I am writing to inform you, that we have received a new Certificate of Lawful Existing Use or Development (CLEUD) application from Leeds Bradford Airport (LBA).
Later today, the application will be published in full on the Council’s Public Access planning system. The CLEUD seeks to establish the lawfulness of take-off and landings at the airport at night, by certain types of aircraft.
CLEUD applications involve a different decision-making process, than an application for planning permission - being based purely on factual evidence assessed against a legal test.
The Town and Country Planning Act 1990 gives local planning authorities the discretion in certain circumstances, to issue a call for evidence from third parties. Today, a call for evidence will begin, with third parties having 21 days to submit any relevant factual information relating to the specific operation of the airport, between January 1st 2010 to December 31st 2019.
The relevant CLEUD application can be viewed on the Public Access system (see the link below), by inputting the reference 26/00926/CLE, into a simple search. Please note that the system will be down between 17.00 and 19.00 today.
If you do have any queries or questions please email planning@leeds.gov.uk."
